Joint Statement regarding CAS appeal – May 19, 2022
Following numerous inquiries from members of the IBA Family,
• Boris van der Vorst, Dutch Boxing Federation President,
• Mike McAtee, USA Boxing Executive Director/CEO,
• Steve Hartley, Boxing New Zealand President, and
• Per-Axel Sjöholm, Swedish Boxing Federation President,
would like to confirm that, through their attorney, they filed a joint Statement of Appeal and Appeal Brief to the Court of Arbitration for Sport (CAS) on May 17, 2022, versus the named Respondent, Boxing Interim Integrity Unit, Interim Nomination Unit of the International Boxing Association (IBA).
IBA’s Constitution states on eligibility and vetting (article 27) that
27.9 The BIIU Nomination Unit shall determine whether or not each candidate for election to office on the Board satisfies the eligibility criteria contained in articles 27.6, 27.7 and 27.8 and shall provide its determination to the IBA Head Office. Should the BIIU Nomination Unit decide that a candidate for an office as Director does not satisfy the eligibility criteria, such decision may be appealed before the CAS by the concerned candidate. Only the candidate (and not his/her National Federation) has standing to appeal. The appeal shall be lodged within 5 (five) days of issuance of the decision and shall be decided by a sole arbitrator to be appointed jointly by IBA and the
candidate or the CAS. The procedure before CAS shall be expedited for an award (without grounds) to be issued at the latest 10 (ten) days after the filing date of the appeal.
Furthermore, CAS’ Confidentiality Rule 43 states that the Appellants, Respondents and the Arbitrator are prohibited from discussing and disclosing, “…any facts or other information…”without the permission of CAS.
The Candidates again stated they believe in the ongoing legal process and are confident they will ultimately prevail. Based on CAS rules and advice from their legal team, they are unable to provide any further comments at this time.
